Man accuses auto business of breach of contract

A Harris County, TX, man says his car was damaged by a local service center he hired to fix it, seeking approximately $12,000 in damages in accusations of fraud, breach of contract and civil policy.

Gregg Williams filed a complaint Aug. 10 in Harris County District Court 11 against E & M Auto Care, Inc. doing business as Lone Star Auto Service.

In the complaint, Williams says he took his 2018 Ford Taurus on Aug. 25, 2021 to Lone Star Auto Service following an accident. The complaint alleges that the “defendant made several specific representations regarding the high quality of the defendant’s work, and that defendant was a ‘preferred service provider’ for State Farm Insurance Company.”


As a result of those claims, the plaintiff says, he engaged Lone StarAuto Service to do the work, which resulted in payments totaling $12,817.49 to the defendant. The complaint says that two weeks after the work was done, the vehicle broke down and was taken to Henson Ford in Madisonville, where diagnostic testing uncovered a transmission fuel leak causing erratic shifting, resulting from the defendant’s work.

The complaint alleges the defendant engaged in fraudulent and deceptive trade and business practices, and made fraudulent representations.

The plaintiff seeks actual and exemplary damages, attorney’s fees, interest, court costs and any other just relief. The plaintiff is represented by Benjamin Palatiere of Palatiere Law Firm in Plano, TX.
