A mother is suing the Houston bar where her son was fatally shot in July, claiming the company committed negligence and didn't provide proper security or training for its employees.
Cristina Gonzalez, individually and on the behalf of the estate of Israel Gonzalez, filed a complaint Aug. 10 in Harris County District Court against Socio 45 Bar LLC doing business as O Bar.
The filing states Israel Gonzalez, the decedent, was in the bar July 23 when an individual came in around 4:30 a.m. without being properly searched and shot him and four other people. He was transported to the hospital and pronounced dead. The filing notes that at the time of the incident, alcohol was being overserved after the legal cut-off time of 2 a.m.
The complaint alleges Socio 45 Bar committed negligence by overserving alcohol; serving after the local cut-off time; failing to train employees on Texas Alcoholic Beverage Commission rules; failing to provide proper security; and failing to properly train employees on proper security procedures.
The plaintiff is also suing for wrongful death and survival action damages. She also seeks exemplary damages, attorney’s fees, interest, and any other just relief.
