Woman sues Houston-area Home Depot claiming sign fell on her

A Harris County woman is suing The Home Depot after sustaining "serious bodily injury" after a sign allegedly fell on her while she was on her way out of the store.

Ramona Crespo filed a complaint Aug. 14 in the 157th District Court of Harris County, TX, against Home Depot U.S.A., Inc. doing business as The Home Depot, according to court documents.

The complaint says that on or about May 13, 2022, the plaintiff was at the Cypress location of The Home Depot, leaving through a designated exit, “when a sign near the automatic sliding exit doors fell and struck her right shoulder and abdomen, causing serious bodily injury.”


The plaintiff alleges the store negligently allowed the premises to become dangerous; negligently permitted the dangerous condition to exist; and failed to maintain the designated exit in a reasonably safe condition for the ordinary use of invitees and particularly for the plaintiff. The plaintiff also alleges the defendant failed to inspect the designated exit to determine whether it as safe for use or discover the existence of dangerous conditions; failed to correct the dangerous condition; and failed to give adequate warning of the dangerous condition despite the fact that the defendant, its agents, servants, and/or its employees, knew, or reasonably should have known of the dangerous condition.

The complaint says The Home Depot “had a duty to exercise ordinary care to keep the subject premises in a reasonably safe condition for the use intended, and owed Plaintiff the duty to inspect the premises and to maintain them in a reasonably safe condition.”

As a result, the plaintiff is requesting damages for past and future physical pain and mental anguish; loss of earning capacity; loss of wages and earnings; disfigurement; physical impairment; medical care; and all other damages to which she may be entitled. She also requests interest and court costs. At this time, maximum damages the plaintiff seeks is $75,000.
