Restaurant consulting firm sues restaurant in breach of contract dispute

A restaurant consulting firm is suing a Louise, TX restaurant, alleging breach of contract and seeking more than $41,000 in damages.

According to court discovery documents, Camellia Monday Consulting LLC filed a complaint Aug. 22 against The Regulator Grill, LLC in the 212th District Court of Galveston County, TX.

The complaint says that Camellia, a consulting firm specializing in restaurant management, operation services, and hospitality, entered into a contract for its services with The Regulator, a restaurant in Louise, on or about Dec. 6, 2022. In exchange, it says, The Regulator agreed to pay Camellia $15,000 per month from Dec. 12, 2022 to March 12, 2023.

The complaint says that in January, citing holiday delays, both parties agreed to extend payments until April, then amended the agreement again in March, stipulating Camellia’s consulting fee would be $10,000 for work performed after March 8.

The complaint says The Regulator agreed to pay $65,000 to Camellia for its work from January to May. It says The Regulator made a $25,000 payment to Camellia on or about March 15, but that $40,000 remains unpaid.

“While The Regulator has represented, both verbally and in writing, on multiple occasions that payment for Camellia’s services would be forthcoming, The Regulator has filed to tender any further payments to Camellia,” the complaint says.

The complaint notes that in July, “representatives for The Regulator said the business was being put up for sale, and once a sale was complete, The Regulator would ‘square up with everyone.’”

The plaintiff is alleging breach of contract, unjust enrichment, and quantum meruit. The plaintiff is requesting actual damages in the amount of $41,908.18, or in the alternative, the reasonable value for the goods and services provided; attorney’s fees; court costs; interest; and any other just relief.

The plaintiff is being represented by Meaghan E. Fischer of Wegener Lane & Evans, P.C. in Houston.
