H-E-B hit with slip and fall lawsuit

A Galveston County, TX, woman is suing a League City grocery store after falling while shopping and sustaining injuries, according to court discovery documents.

Erin Ramos filed a complaint Aug. 24 in the 10th District Court of Galveston County against H-E-B, LP, alleging that Ramos “was walking past the deli section of the store’s property when she slipped and fell on a wet mat, causing her to sustain injuries.” 

The complaint alleges H-E-B was negligent in failing to properly monitor and/or inspect the area where plaintiff was injured; failing to properly maintain the area where plaintiff was injured; failing to properly post warning signs in the area where Plaintiff was injured; and failing to provide plaintiff with a reasonably safe place in which to shop.

The complaint also alleges gross negligence, saying H-E-B “had a duty to use ordinary care to ensure that the premises did not present a danger to plaintiff.”

Ramos is seeking compensatory damages for past and future medical expenses, physical pain and suffering, mental anguish, and physical impairment; lost wages; and loss of earning capacity. She is also asking for actual and exemplary damages, interest, costs of court, and all other just relief.

The plaintiff is being represented by Justin A. Smith and J. Kendon Womack of Sloan, Hatcher, Perry, Runge, Robertson & Smith of Longview.
