An Alvin, TX, resident and his father has filed a wrongful death lawsuit seeking more than $1 million after his son died in a workplace accident.
Alfredo Reyes, Sr. filing as wrongful death beneficiary and heir of Alfredo Reyes, Jr., deceased, filed a complaint Aug. 25 against Marathon Petroleum Company LP in the 56th District Court of Galveston County, TX.
The complaint stated that Reyes Jr. was an employee of Excel Modular Scaffold and Leasing Corp. and was instructed to erect a scaffold at Marathon’s Galveston Bay Refinery. In the course of that job, the complaint says, he died on-site.
“While he was erecting the scaffold, the deceased touched a piece of conduit and was fatally electrocuted,” the complaint stated.
The complaint claimed negligence in that Marathon failed to maintain a safe working environment for workers at the Galveston Bay Refinery;
failed to property de-energize electrical components in the area that the deceased was working at; failed to properly warn the deceased of
known and hidden dangers; failed to properly supervise assigned tasks; failed to utilize appropriate warning devices and signals; and violated
applicable local, state and federal laws and/or regulations; and other negligent acts.
The complaint also alleged gross negligence, stating Marathon’s conduct “involved an extreme degree of risk, considering the probability and
magnitude of the potential harm to others.”
The filing added that, “Marathon’s conduct demonstrates not only an attitude of conscious indifference to the rights, safety, and welfare of others, and also shows Marathon’s actual and subjective awareness of the the dangers of its conduct.”
The plaintiff is seeking wrongful death damages and exemplary damages; costs of court; interest; and any other just relief.
