Trip and fall suit seeks more than $1M from AT&T

A man is suing for more than $1 million after tripping over a cable at a Houston housing complex, claiming negligence resulting in his injuries.

David Delaney filed a complaint Aug. 25 in the 113th District Court of Harris County, TX, against Southwestern Bell Telephone Company doing business as AT&T Texas; Greenbriar Colony, LLC; and "John Doe," as identified in court documents.

The complaint details that on or about Aug. 24, 2022, Delaney was walking at Greenbriar Colony Patio Homes in Houston when he tripped over a cable installed by the defendants a week before the incident. The complaint says the cable was above the ground, but “not visible from Plaintiff’s standpoint.”

The filing alleges Southwestern Bell of negligence, responded at superior and negligent training and supervising. It also alleges negligence was committed by Greenbriar Colony and an unidentified party. It says the defendants created the hazardous condition and knew or should have known of its existence, but failed to provide any warning.

The suit says Delaney suffered serious bodily injuries. He is asking the court for more than $1 million in damages to compensate him for past and future medical care and expenses; pain and suffering; loss of earnings; loss of earning capacity; loss of household services; disfigurement; and mental anguish. He also seeks interest, court cost, and all other just relief.

The plaintiff is being represented by Ningneng ‘Austin’ Xu of Paranjpe Mahadass Ruemke, LLP in Houston.
