A man is suing the owner of the vehicle he was operating for negligence after his seat became detached from the floor.
Tramel Walker filed a complaint Sept. 5 against Kindle Logistics, LLC in the 80th District Court of Harris County, Texas
The complaint says that on or about June 14, Walker was operating a vehicle owned by the defendant when the seat in which he was sitting became unattached from the floor and caused the him to fall backwards. The complaint says this caused Walker to sustain “substantial injuries and damages.”
The suit alleges Kindle Logistics, LLC “owed and assumed a duty to provide a reasonably safe vehicle,” and “breached its duty of ordinary care by failing to adequately warn Plaintiff and by failing to make the unreasonably dangerous condition safe.”
Walker is suing for more than $1 million in actual and compensatory damages for past, present and future medical expenses; pain and suffering; mental anguish; disability and impairment; loss of earnings and earnings capacity; and disfigurement. He also seeks costs of court, interest and all other just relief.
