Woman alleges recently mopped floor at Moody Gardens caused her fall

GALVESTON — A woman claims a recently mopped floor caused her slip and fall at a Galveston aquarium.

Kelly Gavin filed a complaint Sept. 12 in Galveston County District Court against Moody Gardens Inc., alleging liability. 

Gavin, according to her complaint, was at the Moody Gardens property on Hope Boulevard in Galveston on May 9, 2023. She claims the floor had been recently mopped with no warning posted which caused her to fall and suffer a broken wrist and thumb. 

Gavin alleges Moody Gardens' failed to provide a reasonably safe environment, did not keep its walkways clear of hazards and liquids and failed to place signs in the area to warn of the hazard. 

She also alleges Moody Gardens failed to inspect its premises or correct the dangerous defect which caused her slip and fall. Gavin claims the defendant's liability for creating the dangerous condition and that they failed to follow their own protocols regarding responding to a hazard on the premises. She alleges as a result of her fall, she suffered health care expenses, pain, impairment, lost wages and other damages. 

Gavin seeks monetary relief, interest, trial by jury and all other just relief. She is represented by D. Blake Apffel, and Jessica Clark of Apffel Legal PLLC in Galveston.
