Family sues Home Depot for $1 million after heavy box injures woman and young child

A Texas family has filed a negligence lawsuit against Home Depot, claiming that they suffered serious injuries when a heavy box fell on them at a Houston store.

Plaintiffs Paula Ruan and Lucia Ruan, acting as next friend of minor A.B., filed the lawsuit in the District Court of Harris County against Home Depot International, Inc., citing negligence, premise liability, negligent maintenance and failure to warn or repair, and general negligence.

According to the lawsuit,  Paula Ruan was a patron at a Home Depot store in Houston on May 12, 2023. She claims that while she and her family were shopping, she was struck by a falling box that weighed close to 140 lbs. and was thrown to the floor. During the incident, the Ruans tried to protect 3-year old A.B., but the box landed on her shoulder, causing her serious injuries.

According to the defendants, Home Depot had a duty to protect the safety of their visitors and was aware of the dangerous conditions of the aisle where heavy boxes were being loaded. Despite this, the defendant was negligent in its failure to block off the aisle and in its failure to warn customers of the dangerous conditions of the aisle.

Paula claims that as a result of the defendant's negligence, she has sustained severe physical injuries to her back and neck, which have caused her to experience pain, suffering, mental anguish, physical impairment, and lost wages. She claims that her injuries will affect her ability to earn income in the future and that she has incurred medical expenses and will continue to require the services of medical staff to recover from her injuries. She adds that she had pre-existing medical conditions that have become aggravated as a result of the injuries.

According to the lawsuit, A.B. suffered injuries to her back and neck, which have caused her to experience pain, suffering, mental anguish, and physical impairment. The lawsuit adds that she has incurred medical expenses and will continue to require the services of medical staff to recover from her injuries.

The plaintiffs are seeking $1,000,000 in damages plus interest, court costs and any other relief the court deems proper. They are represented in this case by attorney Brittaney M. Gamboa of Brian White & Associates, P.C. in Houston.
