Houston Walmart shopper sues for negligence after slip-and-fall injury in store

HOUSTON – A shopper is suing a Houston Walmart after allegedly slipping and falling in a puddle of water. 

Plaintiff Carina Ayala filed the lawsuit in the Harris County District Court against Wal-Mart Stores Texas, LLC, citing negligence and premises liability. 

According to the lawsuit, Ayala was a patron at a Walmart store in Houston on October 2, 2023. She claims that while exiting the store, she slipped on a puddle of water, causing her to fall and severely injure herself. Ayala claims that she was informed that she was the third person to fall in the exact spot due to the water that had been accumulating on the floor and that there were no signs to warn visitors of the water.

According to Ayala, the defendant negligently failed to properly maintain and inspect the premises to protect the safety of visitors and failed to provide proper warning of the hazardous condition on the premises.

Ayala alleges that she has sustained bodily injuries, which have caused her pain and suffering, mental anguish, physical impairment, disfigurement, and lost wages, and that her injuries will impact her ability to earn income. She adds that she has incurred medical expenses and will continue to require the services of medical staff to recover from her injuries.

The plaintiff is seeking a judgment for damages plus interest, court costs and any other relief the court deems proper. She is represented in this case by attorney Jesus A. Salinas of Daspit Law Firm in Houston.
