HOUSTON - A lawsuit alleging a man was injured when a forklift struck him has been brought against Custom Goods.

Joseph Smith filed the suit on Dec. 18 in Harris County District Court.

According to the lawsuit, on Sept. 27 Smith was struck by a forklift at the defendant’s warehouse facility in Pasadena.

“Defendant failed to ensure its warehouse had safety procedures in place, such as implementing safe paths of travel for the operation of heavy machinery like forklifts, erecting barricades and/or signs, and/or incorporating the proper training and safety procedures at its facility,” the suit states.

“As a result of the incident, Plaintiff suffered serious injuries to multiple parts of his body. Plaintiff has already undergone shoulder surgery as a result of this incident and is still undergoing treatment for his injuries. Plaintiff now brings this suit to recover for his damages.”

The plaintiff is suing for his past and future medical expenses, pain, mental anguish, impairment and lost wages.

He is represented by attorneys Andrew Dao and L. Peyton Chesser of Daly & Black in Houston.
