James Day sues Felipa Landaverde for negligence leading to personal injury

On April 2, 2024, a lawsuit was filed in the County Court at Law, Harris County, Texas (Cause No. 1225467) by plaintiff James Day against defendant Felipa Landaverde. The case revolves around an incident that occurred on June 22, 2022, where the plaintiff alleges he was struck by the defendant's vehicle while performing his duties as a crosswalk attendant for Galena Park Independent School District.

The plaintiff, represented by Poupore Law Firm, asserts that he was wearing a bright orange safety vest and directing traffic when he was hit by the defendant's car. The impact was severe enough to break the driver’s side mirror on the defendant's vehicle and knock Mr. Day to the ground. According to court documents, Ms. Landaverde allegedly drove over two orange traffic cones before hitting Mr. Day.

Mr. Day is seeking monetary relief of $100,000 or less excluding interest, statutory damages or punitive damages and penalties, and attorney fees. He demands compensation for past and future medical expenses, loss of earning capacity, mental anguish, impairment and disfigurement caused by Ms. Landaverde's alleged negligence in operating her motor vehicle.
