Mark Dodson sues Elephant Auto Insurance for auto accident and insurance claim disputes

In the District Court of Harris County, Texas, plaintiff Mark Dodson has filed a lawsuit against Elephant Auto Insurance. The case, bearing the ID 2024-21791 and dated April 5, 2024, revolves around an auto accident and subsequent insurance claim disputes.

The incident occurred on April 13 when Charmaine Andrepont's negligence allegedly caused a collision with Dodson's vehicle. Dodson, represented by attorney Tanni Williams, suffered personal injuries and property damages. He also incurred significant medical expenses and lost wages due to the accident. Andrepont was insured under Elephant Auto Insurance with coverage of only $30,000 which was subsequently tendered.

Dodson himself held a policy with Elephant Auto Insurance that included Personal Injury Protection (PIP) insurance coverage with limits of $2,500 per person and uninsured/underinsured insurance coverage with limits of $30,000 per person. He placed the defendant on notice of claims being made under the insurance policy on April 9, 2024.

Dodson is seeking recovery for his damages through his Underinsured Motorist (UM) coverage provided by his policy issued by Elephant Auto Insurance. He alleges that Andrepont's negligence violated Texas Transportation Code §§ 545.051 and thus she was an underinsured motorist as defined by his uninsured/underinsured motorist coverage underwritten by Elephant Auto Insurance.
