Dawn Rieke sues Kroger Texas for injuries from a fall

On April 4, 2024, Dawn Rieke filed a lawsuit against Kroger Texas, L.P., NewQuest Properties 2021 GP, LLC, and Marshall Cobbs in the District Court of Harris County, Texas. The case ID is 2024-21360 and it pertains to an incident where Rieke suffered injuries due to a fall in a parking lot owned and managed by the defendants.

The plaintiff's lawyer, Patrick O'Hara from O’Hara Law Firm, P.C., outlined that on or around December 2023, Rieke fell in the parking lot of a Kroger location at 20355 Cypresswood Drive, Houston, Texas. The fall resulted in injuries including a wrist fracture. The defendants are accused of painting the parking lot with slick paint which made the property extremely slippery when wet.

Rieke alleges that the defendants owed her a duty of care as she was an invitee on their premises. She claims that they failed to warn her about the dangerous condition of the parking lot and failed to make it reasonably safe. As a result of their negligence, she fractured her wrist.

Rieke is seeking damages for pain and suffering, medical costs, disfigurement and impairment, mental anguish, lost income and other damages within the jurisdictional limits of the court. She seeks less than $1 million in damages along with attorneys’ fees; pre-judgment interest (from the date of injury through the date of judgment) at the maximum rate allowed by law; post-judgment interest at the legal rate; costs of court; and all such other relief to which she may be entitled at law or in equity.
