Donald Browning sues Kroger Texas LP for premises liability

Donald Browning has filed a lawsuit against Kroger Texas LP in the District Court of Harris County, Texas under the case ID 2024-23520. The filing was made on April 12, 2024. The plaintiff alleges that due to the negligence of the defendant, he suffered injuries from a fall on their premises.

The incident occurred on May 16, 2023, at a location owned and operated by Kroger Texas LP located at 360 Cypress Creek Pkwy, Houston, TX. Browning claims that he slipped and fell due to a slippery substance on the floor which resulted in his injuries. He further alleges that an employee of the defendant was aware of the dangerous condition but failed to make the area safe or warn invitees about it.

As a result of this incident, Browning has suffered numerous and serious injuries leading to medical expenses both past and future, pain and suffering both past and future, as well as mental anguish both past and future. The total amount sought for damages is less than $250,000 with a maximum recovery specifically set at $74,999.

Browning seeks judgment against Kroger Texas LP for their alleged negligence under common law theory of premises liability. He requests compensation for his damages along with court costs and pre-judgment interest at the maximum rate allowed by law per year commencing from the 30th day after sum is due until date of judgment.
