Melinda Rios sues 2016 Baytown Ward LLC for premises liability and negligence

In the District Court of Harris County, Texas, Melinda Rios has filed a lawsuit against 2016 Baytown Ward LLC, doing business as Watermark at Baytown Apartments. The case was filed under Cause No. 2024-21696 on April 5, 2024. The plaintiff is represented by attorney Brian Stengel from Smith & Hassler.

The lawsuit alleges that the defendant failed to maintain and inspect its premises, leading to an incident on September 22, 2022, where a section of ceiling in Rios' apartment unit fell onto her causing injury. The plaintiff had made numerous maintenance requests which were ignored by the defendant. Rios claims that she suffered actual damages within the jurisdictional limits of the court due to the defendant's negligence. These damages include physical pain and mental anguish in the past and future; reasonable and necessary costs of medical care and treatment in the past and future; physical impairment in the past and future; lost wages in the past and loss of earning capacity in the future; disfigurement in the past and future; prejudgment or post-judgment interest; and all other reasonable items of damage necessarily incurred as a result of defendants conduct.

Rios is seeking monetary relief over $250,000 but not more than $1,000,000. She also demands trial by jury in this cause and seeks judgment for all other relief to which she may be justly entitled.
