Passenger Sues Bus Company Over Negligence Leading To Severe Injuries

Alejandra Montemayor has filed a negligence complaint against Turimex, L.L.C., doing business as Turimex Internacional. The complaint was lodged in the Harris County District Court on May 15, 2024, with Turimex Internacional named as the defendant.

The lawsuit stems from an incident that occurred on May 18, 2022, when Montemayor was a passenger on a bus operated by Turimex Internacional. According to the complaint, while using the restroom on the bus, Montemayor was ejected from the restroom due to an abrupt acceleration of the vehicle and a malfunctioning lock mechanism on the restroom door. This sudden event caused her to fall onto her knees and elbows, resulting in severe injuries. Montemayor alleges that there were no warning signs or indications of any potential danger at the time of the incident.

Montemayor's legal team argues that Turimex Internacional failed in its duty to maintain safe premises for its passengers. The plaintiff's petition states: "Defendant had a duty to exercise the degree of care that a person of ordinary prudence would use to avoid harm to others under circumstances similar to those described herein." Furthermore, it accuses Turimex Internacional of multiple acts of negligence including failing to maintain and inspect their premises adequately, not warning passengers about potential dangers, and failing to control their speed appropriately.

The complaint also invokes the doctrine of res ipsa loquitur, suggesting that the nature of Montemayor’s injuries indicates negligence on part of Turimex Internacional since they had exclusive control over the bus at the time. Additionally, Montemayor claims that if any misidentification or misnomer occurred regarding parties involved in this case, it should be considered an alter ego situation where corporate veils need piercing for justice.

Montemayor is seeking monetary relief ranging between $250,000 and $1 million for medical expenses incurred both past and future, physical pain and suffering endured both past and future, physical impairment suffered both past and future, as well as mental anguish experienced both past and future. She is also asking for pre-judgment interest from the date of injury through judgment date at maximum legal rates along with post-judgment interest and court costs.
