Plaintiffs Allege Multiple Healthcare Facilities Negligent in Patient's Death

Rachael Marshall and Beverly Puckett have filed a medical negligence complaint against Stanwick Senior Care, LLC, Memorial Hermann Health System, and several other healthcare entities. The complaint was filed in the Harris County District Court on May 22, 2024.

The case centers around the alleged neglect of Jimmy L. Puckett, who suffered severe injuries and ultimately died due to inadequate care at multiple healthcare facilities. According to the plaintiffs, Mr. Puckett fell from a ladder in January 2022, resulting in a traumatic brain injury that required hospitalization and subsequent transfer to various long-term care facilities for rehabilitation. Upon his admission to Courtyard Nursing and Rehabilitation on April 8, 2022, Mr. Puckett had a small wound on his coccyx which deteriorated into severe pressure ulcers due to the facility's failure to provide adequate care.

The plaintiffs allege that Courtyard Nursing failed to monitor Mr. Puckett’s condition properly or implement necessary measures to prevent his wounds from worsening. This neglect continued even after Mr. Puckett was transferred to Memorial Hermann Southeast Houston Hospital for possible pneumonia evaluation on April 25, 2022. Despite being diagnosed with severe pressure ulcers and infections like MRSA during his stay at Memorial Hermann, the hospital staff allegedly did not take appropriate steps to treat his conditions effectively.

Mr. Puckett's condition continued to decline as he was moved between different facilities, including Oakwood Manor Nursing Home and Jefferson Nursing and Rehabilitation Center. Each facility is accused of failing to provide proper interventions or treatment for Mr. Puckett’s progressing pressure ulcers and other health issues. On October 28, 2022, he was rushed to CHRISTUS Southeast Texas - St. Elizabeth Hospital in critical condition with multiple severe infections and sepsis but did not recover despite receiving hospice care at home until his death on December 31, 2022.

The plaintiffs are seeking actual damages exceeding $1 million for medical negligence that resulted in severe injuries and the untimely death of Jimmy L. Puckett. They are requesting compensation for mental anguish, loss of companionship, pecuniary losses, funeral expenses under wrongful-death action damages; pain and suffering endured by Mr. Puckett; past medical expenses; funeral costs incurred by Mr. Puckett’s estate under survival action damages; as well as exemplary damages due to defendants' gross negligence.

Attorneys Patrick W. Powers and Kenneth A. Farah represent the plaintiffs in this case identified as CAUSE NO: 2024-32508 before Judge Tianni Williams in the Harris County District Court.
