Plaintiff Accuses Grocery Chain H-E-B Mi Tienda of Negligence After Slip-and-Fall Incident

A Harris County resident has filed a lawsuit against a major Texas-based grocery chain, alleging negligence and premises liability following an incident that resulted in significant injuries. Carlos Gustavo Argueta lodged the complaint on April 24, 2025, in the District Court of Harris County against H-E-B, LP doing business as Mi Tienda.

The case stems from an incident on July 1, 2024, when Argueta was visiting the Mi Tienda store located at 3800 E. Little York Rd., Houston, Texas. While there, he slipped on water that had spilled on the floor of the produce department. According to the complaint, this hazardous condition was known or should have been known by the store management but was not addressed adequately. The plaintiff asserts that "Defendant failed to use ordinary care to protect invitees from danger by failing to adequately warn Plaintiff of or make safe the dangerous condition." This lack of action is claimed to have directly caused Argueta's injuries.

Argueta accuses H-E-B of failing to maintain its premises safely and reasonably, breaching their duty of care towards customers like him. He further claims that H-E-B lacked sufficient policies or procedures for ensuring customer safety and did not train employees properly in maintaining a safe environment. The petition highlights that if such policies existed, they were not enforced effectively.

The plaintiff seeks monetary relief ranging from $250,000 to $1 million for damages incurred due to his injuries. These damages include past and future medical expenses, physical pain and suffering, mental anguish, loss of earnings and earning capacity, and physical impairment both past and future. Additionally, Argueta requests pre-judgment interest from the date of injury through judgment date at the maximum rate allowed by law along with post-judgment interest at legal rates.
