A slip-and-fall incident at a grocery store has escalated into a legal battle as a Texas resident seeks justice for injuries sustained. Alcides Ferrand Gomez filed a complaint against H-E-B, LP, doing business as Joe V’s Smart Shop, in the District Court of Harris County, Texas, on April 25, 2025.

The case revolves around an incident that occurred on May 12, 2023, when Gomez was shopping at Joe V’s Smart Shop located at 12035 Antoine Dr., Houston. According to the petition, Gomez slipped on liquid present on the floor of the store and suffered serious bodily injuries due to the fall. The plaintiff claims that there were no caution signs or warnings about the hazardous condition of the floor. The lawsuit accuses H-E-B of negligence in maintaining safe premises for its customers. "Defendant failed to adequately maintain the floor," states the petition, which further alleges that H-E-B did not take necessary measures such as placing warning signs or barriers to prevent such accidents.

Gomez argues that his injuries were solely caused by the negligence of H-E-B and asserts that he did nothing to contribute to the accident. The lawsuit outlines several breaches of duty by H-E-B including failing to inspect and maintain safe conditions on their premises and neglecting to warn invitees like Gomez about potential dangers. Citing these failures, Gomez's legal team is pursuing damages for past and future physical pain and suffering, mental anguish, medical expenses, lost wages, and other related losses. They have specified a claim amount exceeding $250,000 but less than $1 million.

The plaintiff's attorneys from J.D. Silva & Associates are demanding a jury trial and seeking both pre-judgment and post-judgment interest along with court costs. They emphasize that their client deserves compensation for both quantifiable economic damages and non-economic damages such as mental anguish. The case has been assigned Case ID 2025-29104 in Harris County's judicial district court under Judge Wanda Chambers' oversight.
