Hotel Guest Sues Hospitality Company Over Negligence Leading to Injuries

A recent court filing has brought to light a serious incident involving a hotel guest who suffered injuries due to alleged negligence. Yvonne Cabrera filed the complaint against HMC of Gunnison LLC in the Harris County District Court on May 29, 2024.

According to the petition, the incident occurred on June 3, 2023, at the La Quinta Inn & Suites by Wyndham hotel located at 27130 Highway 290 in Cypress, Harris County, Texas. Cabrera claims that she was staying at the hotel when she rode an elevator down to the lobby. Upon exiting the elevator, she slipped and fell due to a wet and slippery floor caused by an employee mopping without any warning signs. The plaintiff alleges that this hazardous condition resulted in significant injuries and damages.

The lawsuit accuses HMC of Gunnison LLC of multiple acts of negligence. These include mopping the floor in front of an active elevator without proper cautionary measures, failing to dry-mop or adequately warn guests about the wet floor, and not preventing Cabrera from slipping and falling. "These acts and/or omissions by Defendant and its employees constitute negligence," states the petition. Cabrera argues that these actions were either the sole proximate cause or a contributing factor to her injuries.

Cabrera is seeking monetary relief ranging from $250,000 to $1,000,000 for physical pain, mental anguish, physical impairment, disfigurement, lost wages, loss of earning capacity, and medical expenses incurred both in the past and anticipated in the future. Additionally, she is requesting prejudgment interest at the maximum rate allowed by law on applicable damages and post-judgment interest until full payment is made.

The attorneys representing Yvonne Cabrera are Michael J. Cisneros and Arturo Cisneros from The Cisneros Law Firm LLP based in McAllen, Texas. The case has been assigned Case ID 2024-33655 and will be heard in the 133rd Judicial District Court of Harris County under Judge Marilyn Burgess.
