Local Resident Sues Prominent Medical Facility Over Negligence Leading to Severe Injuries

A local resident has filed a lawsuit against a prominent medical facility, alleging severe injuries due to negligence. On June 7, 2024, Judith Jane Brooks filed a complaint in the Harris County District Court against CHCA West Houston, L.P., doing business as HCA West Houston Medical.

According to the court documents, the incident occurred on June 17, 2022, when Brooks visited the HCA West Houston Medical premises located at 12141 Richmond Ave., Houston, Texas. As she was entering the facility, she tripped over an unattended pallet placed within the ingress and egress area of the premises. The complaint states that there were no warnings or proper safety measures in place to prevent such accidents. Brooks claims that this negligence resulted in significant and permanent injuries.

The lawsuit accuses HCA West Houston Medical of several counts of negligence. These include failing to maintain safe premises, not inspecting for hazards, inadequate safety equipment, and improper training of employees. "Defendant had a duty to exercise ordinary care under the circumstances," reads the petition. "Defendant breached that duty in one or more ways." The plaintiff also alleges gross negligence on part of the defendant for allowing untrained and unsupervised employees to leave an unattended pallet in a high-traffic area.

Brooks is seeking monetary relief exceeding $1 million for physical pain, mental anguish, physical impairment, disfigurement, medical expenses, loss of earning capacity, and punitive damages. She also requests pre-judgment and post-judgment interest as allowed by law.

The case is being handled by Anna J. McMullen from The Amaro Law Firm representing Judith Jane Brooks. The case has been assigned to Judge Bemita Barrett in Harris County District Court under Case ID 2024-36112.
