Harris County Resident Sues Homeowner Over Dog Attack Injuries

A Harris County resident has filed a lawsuit alleging severe injuries from a dog attack at the defendant's home. Madeline Mary Weller lodged the complaint against Michael P. Bollhoefer in the District Court of Harris County, Texas, on June 13, 2024.

According to the court documents, Weller was an invitee at Bollhoefer's residence on June 14, 2022, when she was attacked by his dog. The incident resulted in significant injuries that required emergency medical treatment and stitches. Weller asserts that Bollhoefer failed to control his dog and protect her safety while she was on his premises. She further claims that Bollhoefer knew or should have known about the dog's aggressive tendencies but did not take adequate measures to restrain it.

The lawsuit accuses Bollhoefer of negligence for failing to control his dog, protect guests from potential harm, and properly restrain the animal. Additionally, Weller alleges strict liability against Bollhoefer due to his ownership and possession of a dog with known dangerous propensities. "Defendant is strictly liable for any injuries as a result of his dog's aggressive actions," states the petition.

Weller seeks compensation for medical expenses incurred both past and future, physical pain and suffering, mental anguish, physical impairment, disfigurement, and other damages recoverable by law. The plaintiff requests monetary relief exceeding $250,000 but not more than $1 million. She has also demanded a jury trial to resolve this matter.

Representing Weller is Richard Grimes of Grimes & Fertitta, P.C., while the case will be presided over by Judge Monica Jackson in the 189th District Court under Case ID 2024-37427.
