Plaintiff Alleges Negligence Against Gas Station Operators Following Injury

Antonio Frausto, a Houston resident, has filed a lawsuit against Landmark Industries, LLC and Landmark Industries Energy, LLC, alleging negligence and premises liability after suffering injuries at one of their locations. The complaint was filed on February 28, 2025, in the District Court of Harris County, Texas. Frausto claims that the defendants failed to maintain safe conditions at their TimeWise #808 store in Spring, Texas.

According to the lawsuit, on August 27, 2023, Antonio Frausto visited the TimeWise #808 as a customer when he encountered an unsafe condition in the parking lot. Employees or agents of Landmark Industries were allegedly spraying water on the ground, which led to Frausto slipping and sustaining injuries. The plaintiff asserts that the defendants had a duty to ensure the safety of their premises but neglected this responsibility by not addressing or warning about the hazardous condition.

Frausto's legal team argues that Landmark Industries should have been aware of the dangerous situation and taken measures to correct it. The complaint states that "Defendants knew or should have known of the unreasonably dangerous condition but failed to correct it." Furthermore, it accuses Landmark Industries of failing to properly supervise and train their employees regarding safety protocols. The lawsuit seeks compensation for various damages including physical pain, mental anguish, medical expenses both past and future, lost wages and earning capacity, disfigurement, and interest.

The plaintiff is seeking monetary relief exceeding $250,000 but less than $1 million. In addition to financial compensation for damages incurred due to negligence by Landmark Industries' employees acting within their employment scope—thus making the company vicariously liable under respondeat superior—Frausto demands a jury trial for this case.
