A construction worker has filed a lawsuit against multiple companies for alleged negligence that resulted in severe injuries. Gonzalo Orozco filed the complaint in Harris County, Texas, on June 27, 2024, naming The Allen Hospitality Developers, L.P., Postel Erection Group, LLC, G&A Partners Holding Company, LLC, and G.T. Leach Constructors, LLC as defendants.

The incident occurred on July 12, 2022, at a new construction site located at 1755 Allen Parkway in Houston. According to the plaintiff's petition, Orozco was working at the site when a large metal beam fell on his foot due to the defendants' failure to manage the beam properly. This negligence allegedly led to serious injuries requiring medical treatment. The plaintiff claims that the defendants failed in several key areas including providing personal injury protection, proper supervision and training of personnel, and ensuring safe conditions at the worksite.

Orozco's petition outlines multiple causes of action against all defendants: negligence for failing to provide adequate safety measures and equipment; negligent hiring, training, supervision, and retention of personnel; gross negligence for ignoring extreme risks associated with their actions; and vicarious liability under the doctrine of respondeat superior. The plaintiff argues that these failures directly led to his injuries and seeks monetary relief exceeding $250,000 but less than $1 million.

In addition to compensatory damages for medical expenses, pain and suffering, mental anguish, disability and impairment, disfigurement, lost earnings both past and future, and other out-of-pocket expenses related to the incident, Orozco is also seeking punitive damages due to what he describes as gross negligence by the defendants. He contends that their actions involved an extreme degree of risk which they were aware of but chose to ignore.

The legal team representing Gonzalo Orozco includes Andrew M. Bivona (State Bar No. 24092138), Asad S. Lakhani (State Bar No. 24132315), and Sean M. Patterson (State Bar No. 24073546) from Bivona Law PLLC based in Houston. The case is being overseen by Judge Adiliani Solis in Harris County District Court under Case ID 2024-40875.
