Patient Accuses Medical Clinic of Negligence Leading to Severe Injuries

A 91-year-old patient has filed a lawsuit against a medical clinic, alleging negligence that led to severe injuries. The complaint was filed by Balbir Singh Sekhon and his children, Mandeep Sekhon, Navneet Kaur Rehal, and Navtej Sekhon, in the District Court of Harris County on June 25, 2024, against Wang & Jiang, M.D., P.A., doing business as Nexs Medical and Prompt Care Medical Doctors.

The case revolves around an incident that occurred on June 7, 2024. On this date, Balbir Singh Sekhon visited Wang & Jiang’s Medical Clinic for a vaccination. According to the complaint, the staff directed Sekhon to sit on a round rolling doctor’s exam stool without providing any assistance. As he attempted to sit down, the stool slipped out from under him, causing him to fall and sustain injuries. The plaintiffs argue that the medical staff's failure to provide adequate assistance and safe seating constituted negligence.

The plaintiffs allege that the medical staff at Wang & Jiang failed to meet the accepted standard of care required for elderly patients like Sekhon. "It was apparent or should have been apparent to the Wang & Jiang’s medical staff that the condition of Plaintiff Sekhon (age 91) posed a fall risk," states the complaint. The plaintiffs further contend that this negligence was a proximate cause of Sekhon's fall and subsequent injuries.

In addition to seeking damages for physical pain, mental anguish, physical impairment, disfigurement, and medical expenses for Balbir Singh Sekhon, his children are also pursuing claims for loss of parental consortium and companionship. They argue that their father's serious permanent injury has caused them significant emotional distress and deprived them of his companionship and nursing services.

The plaintiffs are demanding monetary relief exceeding $1 million and have requested a jury trial. They also challenge Chapter 74 of the Texas Civil Practice & Remedies Code as unconstitutional. This chapter includes damage caps and expert report requirements which they claim violate due process and equal protection provisions under both U.S. and Texas Constitutions.

Representing the plaintiffs is Joe B. Stephens from The Stephens Law Firm based in Katy, Texas. The case is presided over by Judge Monica Jackson in Harris County's 165th Judicial District Court under Case ID 2024-40153.
