Harris County Shopper Sues Grocery Chain Over Slip-and-Fall Incident

A slip-and-fall incident at a grocery store has escalated into a legal battle, as a Harris County resident seeks justice for her injuries. Clara Morales filed a complaint against Kroger Texas, LP in the District Court of Harris County, Texas on June 26, 2024.

The lawsuit centers around an incident that occurred on June 28, 2023, when Morales was shopping at a Kroger store located at 360 Cypress Creek Parkway in Houston. According to the complaint, Morales slipped and fell on an unknown liquid that had accumulated on the floor. The plaintiff alleges that Kroger Texas, LP failed to maintain its premises in a reasonably safe condition and neglected to warn customers about the hazardous situation. "Plaintiff was an invitee to whom Defendant owed a duty to use ordinary care," states the complaint.

Morales' petition outlines several specific accusations against Kroger Texas, LP. These include failing to correct the dangerous condition on the premises, not warning customers about it, and not properly inspecting the area to discover such hazards. Additionally, the plaintiff claims that Kroger did not adequately train its employees or implement proper policies to ensure customer safety. The complaint further accuses Kroger of creating the hazardous condition and failing to enforce necessary safety protocols.

The lawsuit invokes premises liability law and argues that Kroger's negligence directly caused Morales' injuries. As a result of her fall, Morales has endured physical pain, mental anguish, and incurred medical expenses. She is seeking compensation for past and future medical costs, lost earnings, physical impairment, disfigurement, and other damages. The total amount sought ranges from $250,000 to $1 million.

Represented by attorneys Jordan A. Glaze and Josh Garrett of Glaze|Garrett law firm based in Gilmer, Texas, Morales is requesting both pre-judgment and post-judgment interest at the highest legal rate allowed by law. The case has been assigned Case ID 2024-40554 and will be heard in the 190th Judicial District Court under Judge Ersoy Ne.
