Chaplain Sues Nursing Home Over Negligence Leading to Severe Injuries

A recent court filing reveals a dramatic legal battle unfolding in Harris County, Texas. Robert Lampkin has filed a lawsuit against Faith Memorial Nursing & Rehabilitation LLC, doing business as Paradigm at Faith Memorial, on June 28, 2024. The complaint accuses the nursing home of gross negligence following an incident that left Lampkin severely injured.

According to the petition filed by Lampkin's attorneys at Armstrong Lee & Baker LLP, the incident occurred on March 25, 2023. Lampkin, a chaplain, was performing his professional duties at the defendant's premises located at 811 Garner Road in Pasadena, Texas. As he returned to his vehicle in the parking lot, he tripped over a large pothole and fell forcefully to the ground. The plaintiff asserts that the nursing home failed to provide any warnings or signs about the hazardous condition of their parking lot.

The lawsuit details how Faith Memorial Nursing & Rehabilitation LLC allegedly neglected its duty of care. "Defendant knew or should have known of the dangerous condition on their Premises which includes the pothole," states the petition. Despite this knowledge, they "disregarded the safety of its invitees" by not repairing or adequately warning about the pothole. As a result of this alleged negligence, Lampkin suffered significant injuries including damage to his right leg and pulmonary complications.

Lampkin is seeking monetary relief ranging from $250,000 to $1 million for medical expenses, physical pain and suffering, mental anguish, physical impairment, disfigurement, lost wages and earning capacity. Additionally, he is pursuing exemplary damages for what he describes as gross negligence on part of Faith Memorial Nursing & Rehabilitation LLC. The complaint argues that when viewed objectively from the standpoint of Defendant at the time of their occurrence, Defendant’s conduct involved an extreme degree of risk considering the probability and magnitude of harm to others.

In addition to claims of negligence and gross negligence, Lampkin also seeks to hold Faith Memorial Nursing & Rehabilitation LLC vicariously liable for its employees' actions under the doctrine of respondeat superior. He alleges that employees failed in their duties to maintain a safe environment and adequately warn him about potential hazards like the pothole.

Representing Robert Lampkin are attorneys Scott P. Armstrong and R. Matthew Franks from Armstrong Lee & Baker LLP. The case has been assigned Case ID 2024-41171 and will be heard in Harris County District Court by Judge Marilyn Burgess.
