Customer Sues Grocery Store Chain Over Negligence After Slip-and-Fall Incident

A customer’s routine shopping trip turned into a legal battle when she slipped and fell on debris at a local grocery store. Maria Salazar filed a complaint against Lewis Food Town, Inc., doing business as Food Town, and Silver Eagle Distributors Houston, LLC, doing business as Silver Eagle Distributors, in the District Court of Harris County, Texas on July 11, 2024.

The lawsuit stems from an incident that occurred on July 12, 2022. Salazar alleges that while she was shopping at the Food Town located at 901 Richey St in Pasadena, Texas, she slipped and fell on cardboard or other debris left on the floor by employees of Silver Eagle Distributors who were setting up a promotional display. According to the complaint, "Defendants' agents and/or employees created the dangerous condition which caused the Plaintiff to slip/trip and fall by casting its unused promotional cardboard and debris onto the flooring where the Plaintiff was injured."

Salazar's petition outlines several accusations against both Food Town and Silver Eagle Distributors. She claims that both entities failed to properly inspect and maintain their premises in a safe condition. Furthermore, they allegedly did not provide adequate warnings about the hazardous conditions present at the time of her fall. The plaintiff asserts that these failures constitute negligence under Texas law. “Defendants breached their duty of care they owed to Plaintiff as an invitee,” states Salazar’s petition.

The plaintiff is seeking compensation for various damages including physical pain and suffering, mental anguish, physical impairment, disfigurement, lost wages and loss of earning capacity, as well as medical expenses incurred due to her injuries. Additionally, Salazar is requesting pre-judgment and post-judgment interest as permitted by law.
