A Harris County resident has filed a lawsuit against a well-known grocery store chain, alleging severe injuries due to the store's negligence. Marisela Aleman lodged the complaint in Harris County Civil Court at Law No. 3 on July 18, 2024, accusing Fiesta Mart, L.L.C., also known as Fiesta, of failing to maintain safe premises.
According to the court documents, Aleman was shopping at a Fiesta Mart location in Harris County on July 2, 2023, when she slipped on water that had leaked from a defective freezer. The incident resulted in severe injuries to her left hip and shoulder. "Plaintiff suffered severe injuries to her left hip, shoulder, and body generally as a proximate result of the dangerous condition created by Defendant," states the petition.
Aleman claims that Fiesta Mart had control over the premises and thus bore responsibility for ensuring a safe environment for its patrons. The lawsuit asserts that Fiesta Mart either knew or should have known about the hazardous condition caused by the leaking freezer but failed to take appropriate action. "Defendant had actual or constructive knowledge of the leaking and defective freezer," alleges Aleman. She further contends that employees walked past the wet floor without addressing the issue or warning customers.
The plaintiff is seeking monetary relief amounting to $250,000 or less, excluding interest and legal fees. She argues that Fiesta Mart's negligence has led to significant physical and emotional suffering, diminished earning capacity, medical expenses, and loss of enjoyment of life. Aleman is also asking for pre-judgment and post-judgment interest at maximum rates allowed by law.
