Tenant Sues Apartment Complex for Negligence After Ceiling Collapse

A resident of Texas has filed a lawsuit against her apartment complex and its management companies, alleging severe injuries due to negligence. Erika Lule filed the complaint in the District Court of Harris County, Texas, on July 19, 2024, naming Agape Meadowcreek, Inc., Foresight Asset Management, LLC, and Foresight Asset Management LLC d/b/a Foresite Star, LLC as defendants.

The incident occurred on June 4, 2023, when Erika Lule was asleep in her apartment at Avistar at Wilcrest in Houston. According to the complaint, part of her ceiling collapsed onto her neck, back, and shoulders while she was inspecting and cleaning up debris from an initial collapse. The plaintiff claims that this incident resulted in severe and continuous injuries. The lawsuit asserts that the apartment complex is owned by Agape Meadowcreek and managed by both Foresight Asset Management entities.

Lule's complaint accuses the defendants of multiple acts of negligence including failing to maintain safe premises, improper management and inspection of the property, not reporting safety hazards, failing to warn residents about these hazards, and inadequate employee training. The plaintiff argues that these negligent actions directly led to her injuries. "Defendants’ conduct demonstrates not only an attitude of conscious indifference to the rights, safety, and welfare of others but also shows Defendants’ actual and subjective awareness of the dangers," reads a portion of the filing.

The plaintiff seeks monetary relief exceeding $250,000 but not more than $1 million for damages including physical pain, mental anguish, disfigurement, loss of enjoyment of life, past and future medical expenses as well as lost earnings. Additionally, Lule is seeking punitive damages due to what she describes as gross negligence on the part of the defendants.

Representing Erika Lule are attorneys Michael E. Pierce and Emiliano Farciert Jr. from Pierce Shrabanek PLLC. The case has been assigned Case ID 2024-45442 in the 151st Judicial District Court with Judge Gerardo Perez presiding.
