Roofer sues Rosehill Roofing & Restoration over severe workplace injury

A harrowing workplace accident has led to a significant legal battle in Harris County, Texas. On July 18, 2024, Fernando Romero Calles filed a complaint against Rosehill Roofing & Restoration, LLC and Steven Tobias, III in the District Court of Harris County. The case, marked by serious allegations of negligence and unsafe working conditions, underscores the critical importance of workplace safety.

The plaintiff, Fernando Romero Calles, claims that on August 17, 2023, while working as a roofer for Rosehill Roofing & Restoration at a job site located at 14106 Bluebonnet Bend in Cypress, Texas, he suffered severe injuries due to an improperly secured ladder. Calles asserts that the incident occurred under the supervision of Steven Tobias III and resulted in "serious and permanent debilitating physical injuries." According to the court documents filed by his attorneys Sarah Y-Nhi Huynh and Hilda Leonor Sibrian from The Huynh Law Firm PLLC and The Law Offices of Hilda L. Sibrian P.C., respectively, Calles is seeking monetary relief between $250,000 and $1 million.

The lawsuit alleges multiple counts of negligence against both defendants. Specific accusations include failing to train and supervise Calles properly, not recognizing or correcting unsafe conditions at the job site, inadequate safety procedures, and providing unsuitable tools and equipment. "Defendants owed a duty to Plaintiff which it breached," states the complaint. It further details how these breaches directly led to Calles' injuries: "Defendants’ acts or omissions constitute negligence and were a proximate cause of the damages sustained by Plaintiff."

Calles is demanding compensation for past and future medical expenses, pain and suffering, mental anguish, physical impairment and disfigurement, lost wages, and loss of earning capacity. Additionally, he seeks pre-judgment interest on any awarded damages as well as post-judgment interest. The plaintiff has also requested a jury trial to resolve these issues.
