Local Resident Sues Property Management Companies Over Negligence Leading to Severe Injuries

A Harris County resident has filed a lawsuit against multiple property management entities and a real estate services company, alleging severe injuries due to negligence. The complaint was lodged by Yaakov Wohlgelernter in the District Court of Harris County on July 19, 2024, targeting Fondrenwood LLC, its associated entities, and Investar Real Estate Services Inc.

According to the court documents, the incident occurred on July 21, 2022, when Wohlgelernter was riding his scooter through a parking lot at the shopping center located at 9810 Fondren Shopping Mall in Houston. The plaintiff claims that his scooter wheel got stuck in a large pothole, causing him to fall and sustain serious injuries to his face and body. Wohlgelernter asserts that there were no warnings about the hazard and accuses the defendants of failing to maintain, inspect, or repair the dangerous condition of the parking lot.

The lawsuit details how Fondrenwood LLC and its associated entities—Fondrenwood One LLC, Fondrenwood Two LLC, Fondrenwood Three LLC, and Fondrenwood Four LLC—along with Investar Real Estate Services Inc., owned and managed the premises where the incident took place. Wohlgelernter alleges that these entities had actual or constructive knowledge of the hazardous pothole but neglected their duty to ensure safety for invitees like himself. "Defendants failed to exercise ordinary care to protect Plaintiff from those risks," reads part of the complaint.

Wohlgelernter is seeking damages for medical expenses incurred both past and future, physical pain and mental anguish endured as a result of the accident, physical impairment and disfigurement suffered, loss of wages and earning capacity. He is asking for an amount exceeding $250,000 but not more than $1 million. Additionally, he demands pre-judgment and post-judgment interest as allowed by law along with court costs.

Representing Wohlgelernter are attorneys Stephen Goldenzweig from Goldenzweig Law Group PLLC and Jacob D. Cukjati from Martin & Cukjati LLP. The case has been assigned Case ID 2024-45352 in Harris County's 113th Judicial District Court.
