Plaintiff alleges property owner’s negligence after dog attack leaves him injured

A recent court filing has brought to light a harrowing incident involving a dog attack that left the plaintiff severely injured. On July 24, 2024, Charlie Powell filed a complaint in the Harris County District Court against Brian A. Cisneros and Better World Properties, LLC.

According to the complaint, on April 21, 2023, Charlie Powell was walking on Beverly Hill Street in Houston, Texas when he was viciously attacked by a dog owned by Brian A. Cisneros. The property where the incident occurred is owned by Better World Properties, LLC. Powell alleges that Cisneros was aware of his dog's aggressive tendencies prior to the attack but failed to take necessary precautions to restrain or control the animal. "Defendants owed a legal duty to Plaintiff to properly restrain and protect people from the dog," states the complaint.

The lawsuit outlines several accusations against Cisneros and Better World Properties, LLC. It asserts that Cisneros breached his duty by failing to train or restrain his dog adequately, leading directly to Powell's injuries. Additionally, Powell claims that Cisneros violated multiple regulations under Texas Health & Safety Code § 822 and local ordinances requiring dangerous dogs to be restrained at all times. "Section 6-3 of the Code of Ordinances, City of Houston, TX states that an owner or any other person having the right of possession of an animal shall ensure that the animal does not run at large," reads one part of the filing.

Powell is seeking damages for pain and suffering, medical expenses, disfigurement and impairment, mental anguish, economic losses, and non-economic damages. He also requests exemplary damages due to what he perceives as gross negligence on the part of Cisneros and Better World Properties, LLC.

Represented by Patrick O'Hara from O'Hara Law Firm P.C., Powell has demanded a jury trial for this case. The case has been assigned Case ID 2024-46749 and will be presided over in Harris County's 270th Judicial District Court.
