Houston Woman Sues Real Estate Companies Over Negligence Leading to Trip-and-Fall Accident

A Houston woman has taken legal action against two companies, claiming their negligence led to her serious injuries. Linda Aber filed a complaint on April 25, 2025, in the District Court of Harris County, Texas, accusing 1220 Augusta, LLC and Nations Reliable Lending, LLC (doing business as NRL Mortgage) of creating hazardous conditions that resulted in her trip and fall accident.

According to the petition, Linda Aber was injured on July 11, 2023, while she was a lawful invitee at the defendants' premises located at 1220 Augusta Drive in Houston. The complaint details how Aber fell due to an uncovered hole left negligently by the defendants. "The concealed, manmade tripping hazard... presented an unreasonable risk of harm," states the petition. Despite being aware of this dangerous condition, the defendants allegedly failed to take necessary precautions or warn Aber about it.

Aber's lawsuit accuses the defendants of multiple counts of negligence under premises liability law. She argues that they failed to maintain a safe environment for invitees like herself and neglected to follow safety protocols that could have prevented such accidents. The complaint also claims gross negligence on part of the defendants for their conscious disregard for safety by not addressing or warning about the hazardous condition despite knowing its risks.

The plaintiff is seeking monetary relief ranging from $250,000 to $1 million for her injuries which include physical pain and mental anguish both past and future, lost earnings and loss of future earning capacity, physical impairment and disfigurement as well as medical expenses incurred and anticipated. Additionally, Aber demands punitive damages due to what she perceives as gross negligence by the defendants.
