On April 24, 2025, Yaneth Vianey Garza initiated legal proceedings against Petsmart, LLC, KIR Pasadena I, LP, and KIR Pasadena II, LP in the District Court of Harris County. The complaint alleges that these entities failed to maintain safe conditions at a pet store location in Pasadena, Texas.
According to the court documents, the incident occurred on July 12, 2023, when Garza visited a PetSmart store located at 5722 Fairmont Parkway. As she entered the premises to purchase pet supplies, she tripped over uneven pavement in the common area. Garza claims that this hazardous condition was known or should have been known by the defendants but was neither addressed nor adequately warned against. "Defendants failed to make safe and/or adequately warn Plaintiff of the unreasonably dangerous condition," states the petition.
Garza's lawsuit accuses Petsmart and its associated entities of several counts of negligence including failing to maintain safe premises, failing to correct known hazards like uneven pavement, and not warning customers about potential dangers. Furthermore, she asserts that there was a lack of proper training for employees on how to handle such unsafe conditions. The plaintiff argues that these oversights directly led to her injuries which required extensive medical treatment.
The plaintiff is seeking monetary relief exceeding $1 million for medical expenses incurred and anticipated future costs related to her injuries. She also demands compensation for pain and suffering endured both past and future as well as mental anguish resulting from the incident. In addition to actual damages, Garza requests pre-judgment interest from the date of injury through judgment date along with post-judgment interest and court costs.
