Tenants Sue Apartment Complex Over Negligence Leading to Severe Injuries

A catastrophic incident at a Houston apartment complex has led to a significant legal battle. On July 23, 2024, Calvin Cains and Rotarious Charles filed a complaint in the District Court of Harris County, Texas, against Carriage Place Apartments Houston LLC. The plaintiffs allege that the defendant's negligence resulted in severe injuries sustained from a falling ceiling fan.

According to the court filing, the incident occurred on September 13, 2023, at the defendant’s premises located at 550 Wells Fargo Dr., Houston, TX. Plaintiffs Calvin Cains and Rotarious Charles were guests at Carriage Place Apartments when an unmaintained ceiling fan unexpectedly collapsed, causing them serious and permanent injuries. The plaintiffs assert that Carriage Place Apartments had actual knowledge of the dangerous condition posed by the old and poorly maintained ceiling fan but failed to take necessary precautions or warn about the hazard.

The complaint outlines that as licensees on the property, Cains and Charles were owed a duty of care by Carriage Place Apartments. The plaintiffs argue that this duty was breached due to negligence on part of the defendant’s agents or employees. Specifically, they accuse Carriage Place Apartments of allowing a hazardous condition to exist and failing to provide adequate warning about it. "Defendant did not exercise reasonable care to reduce or eliminate the risk," states the complaint.

The plaintiffs are seeking compensatory damages for their physical pain, mental anguish, physical impairment, loss of earnings and earning capacity, disfigurement, and medical expenses both past and future. They claim these damages fall within the jurisdictional limits of the court and request relief amounting between $250,000.00 and $1,000,000.00.
