Tenant Sues Property Management Company Over Negligence Leading to Severe Injury

A Harris County resident has filed a lawsuit against a Texas corporation, alleging severe negligence that led to her injury. Griselda Gonzalez lodged the complaint in the District Court of Harris County, Texas, on July 25, 2024, accusing 13100 Northwest One, LLC of failing to maintain safe premises.

The case revolves around an incident that occurred on January 23, 2024. Gonzalez claims she was injured while navigating through the defendant's multi-story parking garage located at 13105 Northwest Freeway in Houston. According to the petition, heavy rain had caused large puddles to form on the third floor of the parking garage due to leaks from cracks and holes in the ceiling and pillars. These conditions made the stairwell slippery and hazardous. Gonzalez slipped and fell while descending the wet cement stairs that lacked anti-slip strips, resulting in serious injuries.

Gonzalez asserts that as a business invitee working for Harris County Toll Road within the defendant’s premises, she was owed a duty of care by 13100 Northwest One, LLC. The plaintiff argues that the company failed to inspect and rectify these dangerous conditions or provide adequate warnings about them. "Defendant had actual or constructive knowledge and knew or should have known of this dangerous condition as it was an ongoing concern during rainy days," states Gonzalez in her petition.

The plaintiff is seeking over $1 million in damages for physical pain and disability from the date of injury to trial, future physical pain and disability, mental anguish both past and future, loss of earnings and earning capacity, medical expenses both past and anticipated future costs, physical impairment, loss of consortium including family relationship damages such as care and companionship losses both past and future. Additionally, Gonzalez is pursuing exemplary damages due to what she describes as gross negligence by the defendant.

Gonzalez's attorney is Timothy N. Smith from Higdon Lawyers. The case has been assigned Case ID 2024-47018 in Court 157 with Judge Marilyn Burgess presiding.
