Customer Sues Grocery Chain for Negligence After Slip-and-Fall Incident

Adolfo Vargas has taken legal action against a well-known grocery chain, claiming negligence led to his severe injuries. On April 15, 2025, Vargas filed a complaint in the District Court of Harris County, Texas, against Kroger Texas L.P., alleging that their negligence resulted in a hazardous condition that caused him harm.

According to the petition, on July 10, 2024, Vargas was shopping at the Kroger store located at 25651 Hwy. 59 N., Kingwood, TX when he slipped and fell due to water leaking from freezers onto the floor. The lawsuit asserts that Kroger and its employees knew or should have known about this dangerous condition and failed to take appropriate measures to rectify it or warn customers. Vargas contends that this oversight constituted negligence on the part of Kroger, as they had a non-delegable duty of care towards their invitees.

Vargas's complaint outlines several damages he claims to have suffered as a result of the incident. These include physical pain and disability from the time of injury up until now and anticipated future suffering. He also cites mental anguish and embarrassment experienced since the accident and expected in the future. Additionally, Vargas seeks compensation for lost earnings both past and future, medical expenses incurred due to his injuries, and anticipated future medical costs. In total, Vargas is seeking monetary relief amounting to less than $70,000.

Represented by attorney Adam P. Criaco from Criaco & Samperi Law Firm in Houston, Texas, Vargas requests that Kroger be summoned to court to respond to these allegations. The case is being handled under Level 3 discovery control plan according to Texas Rules of Civil Procedure. The petition emphasizes that any documents produced during discovery will be considered authenticated for use against the producing party in court proceedings.

The case is filed under Case ID 2025-26345 with Judge Marilyn Burgess presiding over it in Harris County's 333rd Judicial District Court.
