A worker's lawsuit has been filed against a lawn service company, alleging negligence that led to severe injuries. On July 31, 2024, Jorge Ortiz Acevedo submitted a complaint in the Harris County District Court against Oscar Mauro Rodriguez, doing business as Rodriguez Lawn Service.
According to the complaint, Ortiz Acevedo was injured on December 9, 2023, while working for Rodriguez Lawn Service in Harris County, Texas. The plaintiff claims he was using equipment provided by the defendant to remove tree trunks when the equipment failed, causing a tree trunk to fall and strike him. As a result of this incident, Ortiz Acevedo sustained serious physical injuries.
The plaintiff alleges that his injuries were due to multiple acts of negligence on the part of Rodriguez Lawn Service. These include failing to properly train and supervise employees, not recognizing and correcting unsafe conditions at the job site, and not providing adequate safety rules or procedures. Additionally, the plaintiff accuses the defendant of failing to furnish safe tools and equipment and not maintaining machinery properly. "Defendant’s acts and/or omissions constitute negligence," states the complaint.
Ortiz Acevedo is seeking monetary relief not exceeding $75,000 for damages including medical expenses, pain and suffering, mental anguish, physical impairment and disfigurement, lost wages, and loss of earning capacity. He also requests pre-judgment and post-judgment interest as well as court costs.
