Restaurant Sued Over Slip-and-Fall Incident

A Harris County woman has filed a lawsuit against a local restaurant, alleging negligence after suffering injuries from a slip and fall incident. Erica Johnson lodged the complaint in the District Court of Harris County on August 7, 2024, targeting The Savoy at Legacy Lane LLC and its associated entities.

The case revolves around an incident that occurred on November 11, 2023, when Johnson visited The Savoy restaurant located at 4402 Emancipation Ave., Houston, TX. According to the petition, Johnson slipped and fell on a wet floor near the bathroom area due to the absence of any warning signs. She sustained injuries to her left leg, hip, and knee as a result. "Defendants owed Plaintiff a duty of ordinary care to protect from injury and to safeguard Plaintiff from unreasonably dangerous conditions," states the petition.

Johnson asserts that The Savoy's failure to notify patrons about the slick floor constitutes negligence. The petition claims that this hazardous condition was either known or should have been known by the defendant through ordinary care. Consequently, Johnson had to seek medical treatment for her injuries. "The premises were overseen by the Defendant at the time of the incident," reads another section of the filing.

In her lawsuit, Johnson accuses The Savoy of multiple counts of negligence including failing to inspect and maintain safe premises, not remedying or cleaning up the dangerous condition promptly, and not providing adequate warnings about potential hazards. Furthermore, she invokes the doctrine of Respondeat Superior, holding The Savoy accountable for its employees' actions during their course of employment.

Johnson is seeking over one million dollars in damages for pain and suffering—both past and future—mental anguish, medical expenses (past and future), physical impairment and disfigurement (past and future), lost wages (past), loss of future wage-earning capacity, pre-judgment interest, post-judgment interest, and exemplary damages. She also demands a jury trial for her case.

Representing Erica Johnson is attorney Olorunsola Olumide from The Law Office of Thomas J. Henry based in Austin, Texas. The case is filed under Case ID 2024-50423 in front of Judge Marilyn Burgess at Harris County's 113th Judicial District Court.
