Tenant Sues Property Management Companies Over Ceiling Collapse Injuries

A tenant's worst nightmare unfolded when a ceiling collapsed, causing severe injuries and sparking a lawsuit. On August 14, 2024, Geraldenese Freeman filed a complaint in the Harris County District Court against Comcapp West Oaks, LLC and Commerce Capital Partners, LLC.

Freeman's ordeal began on March 29, 2022, when she noticed puckering and bubbles in her apartment ceiling at 2400 Briarwest Blvd., Houston. Despite reporting the issue to maintenance, who sprayed bleach instead of inspecting for leaks, the problem persisted. Months later, on December 14, 2022, the ceiling gave way while Freeman was showering, leading to injuries to her arm, neck, and back. Her daughter-in-law rushed her to an emergency center after hearing her cries for help.

Freeman alleges that the defendants failed in their duty of care by not addressing the dangerous condition of the premises despite being aware of it. She accuses them of negligence and gross negligence for not taking reasonable steps to ensure safety. Additionally, she claims negligent hiring and supervision of employees who were responsible for maintenance but failed to perform their duties adequately.

Freeman seeks over $1 million in damages for medical expenses, physical pain and suffering, mental anguish, disfigurement, loss of earning capacity, and other related costs. She also demands a jury trial to resolve these issues.

Representing Freeman are attorneys Roxell Ann Richards and Gary Washington from The Roxell Richards Law Firm. The case is assigned Case ID 2024-53080 with Judge Wanda Chambers presiding in the 164th Judicial District Court.
