Customer Sues Grocery Chain Kroger for Negligence After Slip-and-Fall Incident

Mary Lou Palacios Lumbreras has taken legal action against a major grocery chain, filing a lawsuit in Harris County, Texas, on November 7, 2024. The plaintiff accuses Kroger Texas, LP of negligence following an incident at one of its stores that resulted in personal injury. This case highlights the ongoing concerns regarding customer safety and corporate responsibility in retail environments.

The complaint was filed by Mary Lou Palacios Lumbreras after she allegedly slipped and fell on an unknown liquid at a Kroger store located at 12434 TX-249 in Houston on February 19, 2024. Represented by attorneys Jordan A. Glaze and Josh Garrett from the law firm Glaze | Garrett, Lumbreras asserts that Kroger Texas failed to maintain safe premises for its customers. The plaintiff argues that as an invitee to the store, she was owed a duty of care which the defendant breached by not ensuring the floor was free from hazards or warning her about potential dangers.

Lumbreras's lawsuit outlines several accusations against Kroger Texas, including failing to maintain a safe environment, neglecting to correct hazardous conditions, and not adequately training employees to prevent such incidents. She claims these oversights constitute negligence under premises liability laws. Furthermore, the plaintiff contends that Kroger's employees were acting within their employment scope during the incident, making the company liable under the doctrine of respondeat superior.

The plaintiff seeks compensation for various damages resulting from her fall. These include past and future medical expenses, physical pain and suffering, mental anguish, loss of earnings and earning capacity, physical impairment and disfigurement both past and future. Lumbreras estimates her damages could exceed $250,000 but remain below $1 million. Additionally, she requests pre- and post-judgment interest at the highest legal rate allowed.

The case is being handled in the District Court of Harris County with Judge Maryn Buress presiding over proceedings under Case ID 2024-78683. Attorneys Jordan A. Glaze and Josh Garrett are representing Mary Lou Palacios Lumbreras in this legal battle against Kroger Texas.
