A Texas resident has filed a lawsuit against multiple housing management companies, alleging severe negligence that resulted in personal injury. Mary Mendoza filed the complaint on August 14, 2024, in the Harris County District Court against American Opportunity for Housing Inc., Foresight Management LLC, and Foresight Assets Management LLC.
The case centers around an incident that occurred on August 27, 2022, at an apartment located at 301 W. Little York Road in Harris County, Texas. According to the plaintiff's petition, Mendoza was injured when a large bathroom shelf fell unexpectedly due to improper mounting hardware and retaining clips. The falling shelf struck Mendoza, causing severe injuries including a laceration to her nose and a head injury. "As a result of the incident, Plaintiff suffered severe personal injuries," states the complaint.
Mendoza alleges that the defendants were negligent in maintaining the property. She claims they failed to inspect for hazards, repair defects, warn tenants of dangerous conditions, and implement proper maintenance plans and procedures. The complaint accuses the defendants of gross negligence for allowing tenants to reside in apartments with improperly mounted shelves and other hazardous conditions. "Defendants had actual knowledge of the dangerous condition of the Property," reads one part of the filing.
The plaintiff is seeking monetary relief ranging from $250,000 to $1 million for damages including physical pain, mental anguish, medical expenses, loss of earning capacity, and punitive damages. Additionally, Mendoza requests pre-judgment and post-judgment interest as allowed by law and reimbursement for court costs.
