Grieving Family Sues Nursing Facility Over Alleged Negligence Leading To Death

A grieving family has filed a lawsuit against a nursing facility and associated parties, alleging gross negligence leading to the death of their loved one. On August 12, 2024, Roy Mays filed a complaint in the Harris County District Court against Focused Care at Cedar Bayou and other related entities.

According to the complaint, Kytha Beo was admitted to Focused Care at Cedar Bayou on March 23, 2023, following a stroke. She had a PEG feeding tube upon admission. The plaintiff alleges that there were no records of any maintenance or assessments of the feeding tube or her skin condition. Dr. Matthew Roberts, who was responsible for her care, ordered an incorrect type of x-ray on May 30, 2023, which failed to identify the placement of the PEG tube. On June 9, 2023, Ms. Beo was transferred to Methodist Baytown Hospital with an infected PEG site and cellulitis and sepsis due to feeding tube displacement. Despite extensive treatment including surgical debridement, she succumbed to her injuries on October 2, 2023.

The plaintiff claims that Focused Care at Cedar Bayou and its affiliates were negligent in several ways: failing to avoid preventable complications with the feeding tube; not performing timely or accurate assessments; failing to report significant changes in condition; inadequate staffing; and lacking proper policies and procedures. These breaches allegedly contributed directly to Ms. Beo's suffering and eventual death.

In addition to these allegations against the nursing facility and its staff, Dr. Matthew Roberts is accused of failing to perform necessary assessments and reporting diagnostic radiology studies appropriately. Geriatric Home Care Physicians P.A., where Dr. Roberts is employed, is also named as a defendant under vicarious liability principles.

The plaintiffs are seeking various forms of relief from the court including actual damages for loss of companionship and mental anguish suffered by Ms. Beo’s family members both past and future; medical expenses incurred before her death; funeral costs; and punitive damages for what they describe as willful misconduct by the defendants.

Representing the plaintiff is John J. Brothers from The Brothers Law Firm while details about defense attorneys remain undisclosed as of now. The case has been assigned Case ID: 2024-52116 in the Harris County District Court presided over by Judge Christopher Matthews.
