Bryanna Thomas-Virginia has taken legal action against a prominent Texas corporation, alleging negligence that resulted in serious personal injuries. On November 7, 2024, Bryanna Thomas-Virginia filed a complaint in the District Court of Harris County, Texas, against Fertitta Entertainment, Inc., and 1600 West Loop South, LLC.
The lawsuit stems from an incident on March 11, 2023, when Thomas-Virginia was visiting The Post Oak at Uptown Houston. She claims to have slipped and fallen on a wet floor within the premises owned and managed by the defendants. According to the petition, this hazardous condition posed an unreasonable risk of harm to visitors like her. The plaintiff asserts that the defendants were aware of the danger but failed to exercise ordinary care by not making the premises safe or adequately warning her about the condition. As a result of this alleged negligence, Thomas-Virginia suffered significant injuries.
Thomas-Virginia's petition outlines several accusations against Fertitta Entertainment and 1600 West Loop South. She accuses them of failing to maintain a safe environment for invitees and neglecting to correct or warn about the dangerous condition of the floor. Furthermore, she claims they did not properly inspect their premises or train their employees on maintaining safety standards. These actions—or lack thereof—are described as constituting negligence that directly led to her injuries.
In terms of relief sought from the court, Thomas-Virginia is requesting monetary compensation exceeding $1 million for damages including medical expenses (both past and future), physical pain and mental anguish, physical impairment, disfigurement, loss of earning capacity, as well as pre-judgment interest and court costs. Her attorney argues that any pre-existing conditions she may have had were exacerbated by this incident due to the defendants' negligence.
Representing Bryanna Thomas-Virginia is attorney Jonathan C. Kieschnick from Houston-based law firm JCK Law Firm. The case is being overseen by Judge Nelson Cuero in Harris County's 55th Judicial District under Case ID 2024-78589.
