Plaintiff blames neighbor for negligence after dog attack

A neighborhood walk turned into a nightmare when an individual was attacked by a dog due to the alleged negligence of a property owner. Meena Singh filed a complaint against Tracy W. Arthur in the District Court of Harris County, Texas, on August 28, 2024.

According to the complaint, on January 23, 2023, Meena Singh was walking near Tracy W. Arthur's property at 11819 Granite Manor Ln in Cypress, Texas. Singh alleges that Arthur's dog ran through a dilapidated fence and attacked her. The plaintiff contends that the defendant's failure to maintain the fence and restrain the dog led directly to her severe injuries. Singh claims she suffered physical harm necessitating medical attention and was unable to work during her recovery period.

Singh asserts that Arthur had constructive knowledge of the damaged condition of the fence and failed to take reasonable measures to protect against such dangers. The complaint states, "Defendant’s negligence was the actual and proximate cause of Plaintiff’s injuries." Furthermore, Singh accuses Arthur of failing to maintain a safe property and allowing unnecessary hazards to exist.

The lawsuit includes two counts: Negligence-Premises Liability and General Negligence. In both counts, Singh incorporates all previous paragraphs from her petition and emphasizes that Arthur's negligence was the direct cause of her injuries. The plaintiff details several acts of negligence by Arthur, including failing to maintain a secure fence and not adequately warning neighbors about potential dangers posed by her dog.

Singh is seeking monetary relief of less than $250,000 for various damages including past and future medical costs, pain and suffering, mental anguish, lost wages, physical impairment, disfigurement, pre- and post-judgment interest, costs of suit (including service of process fees), depositions, expert witness fees, and any additional relief deemed appropriate by the court.
