Dental Practice Faces $1 Million Negligence Lawsuit Following Patient Injury

A local dental practice faces serious allegations of negligence following a patient's severe injuries. Kathee Gaskin filed a complaint in the District Court of Harris County, Texas, on September 3, 2024, against Dental Implant Associates of The Woodlands, P.A., doing business as ClearChoice Dental Implant Center, along with Dr. Rhonda Jacob and Dr. Robert Morris.

The lawsuit centers around an incident that occurred on April 25, 2024. According to the complaint, Gaskin sustained significant injuries due to the alleged negligent acts and omissions by the defendants. The plaintiff claims that Dr. Robert Morris was acting as an employee or agent of Dental Implant Associates of The Woodlands at the time of the incident, making the company liable under the doctrine of respondeat superior. Similarly, Dr. Rhonda Jacob is accused in her capacity as a principal and managing agent of the same dental practice.

Gaskin's legal team argues that all conditions precedent to filing this action have been satisfied and that they have complied fully with Chapter 74 of the Texas Civil Practice & Remedies Code. Attached to the petition is a curriculum vitae and expert report from Dr. Andrew Ochroch, M.D., supporting Gaskin's claims.

The plaintiff seeks extensive damages for physical pain, mental anguish, medical expenses incurred up to trial, and future costs related to ongoing treatment and impairment. Specifically, Gaskin requests compensation for her inability to perform daily tasks and services she could ordinarily handle before the incident. She also seeks redress for loss or reduction in her earnings or earning capacity due to her injuries.

In total, Gaskin is seeking monetary relief exceeding $1 million from the defendants jointly and severally. The complaint requests that upon final trial, she be awarded damages covering past and future losses along with court costs and interest at both pre-judgment and post-judgment rates.
