Wind Turbine Mechanic Sues Renewable Energy Companies Over Severe Injury

A wind turbine service mechanic has filed a lawsuit against a major renewable energy company following a severe injury sustained on the job. Jerson Kelly, the plaintiff, lodged his complaint in Harris County District Court on September 13, 2024, targeting Post Oak Wind LLC, doing business as Lone Star Wind Farm, and EDP Renewables North America LLC.

According to the petition, Kelly was employed by Run Energy and was working at the Lone Star Wind Farm in Abilene, Texas, on August 16, 2023. While servicing a turbine at the farm owned and controlled by the defendants, Kelly claims he was electrocuted by a malfunctioning hoist remote control. The shock caused him to fall from his platform, resulting in severe personal injuries. The plaintiff alleges that employees of the defendants were aware of the faulty condition of the remote but failed to take corrective action or warn him about it.

Kelly's lawsuit accuses Post Oak Wind LLC and EDP Renewables North America LLC of negligence for failing to properly train their employees, inspect the premises for hazards, and provide necessary safety equipment. "Defendants had the right to control as well as actual control and supervision of the job site," states Kelly in his petition. He further asserts that this lack of oversight directly led to his injuries.

The plaintiff is seeking monetary relief exceeding $1 million for medical expenses, lost wages, physical impairment, mental anguish, and other damages. Additionally, Kelly is pursuing exemplary damages for gross negligence and malice under Texas law. He contends that the defendants acted with "reckless disregard for safety" by continuing operations despite knowing about the hazardous condition.

Representing Jerson Kelly is attorney Warren M. Armstrong from Armstrong Law PLLC. The case has been assigned to Judge Bernitta Barrett in Harris County District Court under Case ID 2024-62444.
